BROKER TERMS: What to expect & how we get paid...

I want to take a moment to make sure you understand our sales process. By agreeing to these conditions before we start, there is less confusion as we go:

1. 15% COMMISSION: We work on a commission basis (15%) that is based on the gross sales price of the equipment. If we sell it for $1,000, we invoice you for $150, giving you a "net" of $850. We don't add our commission to your final asking price. We don't ask for any kind of exclusive on the equipment or any kind of listing fee. If during the time we are marketing your equipment you change your mind, find another buyer, etc., just let us know and you owe us nothing. We only get paid if we find a buyer for your equipment at terms you accept. We have no minimum commission or maximum commission, a flat 15%.

2. SELLER PAYS OUR COMMISSION: We don't ask for or accept any compensation from the buyers. By only getting compensated from the seller, it keeps our focus on getting the best price available for your equipment.

3. E-MAIL MARKETING: We have internally developed "email databases" in several different industries. We "target list" your product to the one(s) we feel best suits your equipment. Most of our customers are DEALERS.

4. "BLIND LISTINGS": When we send out a "For Sale" or "Wanted" listing, we don't put your information in the listing. All negotiations are done thru us until an agreement is reached, then we introduce the buyer to the seller.

5. SELLING PRICE: We never try to tell someone what their equipment is "worth". I am a firm believer that it is only "worth" what you can find someone willing to pay for it. We simply present you with offers from "qualified & motivated" buyers.

6. YOU SEE ALL OFFERS: I don't "screen" the offers. It is my job to present your "asking" price and in turn to present you with any and all counter offers we receive.

7. BUYER & SELLER DEAL DIRECTLY: Once the deal is agreed to by both parties, you will invoice the buyer directly. They will remit 100% of the funds directly to you. Once you get "good funds", you release the equipment. We invoice you for our 15% commission after the deal is confirmed and our invoice is due when the equipment has been delivered/picked up. If for some reason the deal is not completed, there is no fee. Again, we ONLY get paid when we make a sale and both parties are happy with the results.

8. BUYERS PAY SHIPPING: Our buyers pay their own shipping. We recommend that the sellers not get involved in providing the freight or recommending a shipper. My experience is that it is best to let the buyer handle this on their own. If the equipment lends itself to a UPS or Fed Ex type shipping, we normally ask the buyer to provide their account number. In these instances, we ask the seller to box and ship "collect" on the buyer's acct.

9. NO EXTENDED WARRANTY: If you are selling the equipment as "good, working", we ask that it is in that shape. We always give the buyers the option of inspecting the equipment prior to purchase (at their own expense) and depending on the size of the sale, many will send a tech to test/inspect prior to purchase. but if they get the equipment and it works, but call 30 days later with "we have a problem"....there is no warranty. We are very clear on this issue.

10. PREPAY PRIOR TO SHIPPING: Our normal terms are prepay prior to shipping. If not certified funds, seller has option to wait on check to clear.

11. FUTURE SALES: We trust that both the buyer and seller have associated "value" with our service and will notify us of any additional sales between them. Chances are we'd never really know if we got bypassed, but we don't lose any sleep over it.
